Article 2:   Scope of application of the GCS

The General Conditions of Sale drawn up here apply to all purchases made at the company Vinatis on its online store via the website or by phone. To find out the conditions of sale relating to your order, even if the order has not yet been placed, simply click on «  General Conditions of Sale ».


The creation and payment of an order implies full and unreserved adherence to all the clauses present in the GCS. An agreement that establishes special conditions can only be accepted in written form, otherwise these GCS are applied to all legal effects in the contractual relations between the Customer and the Diegale company.


The offers presented by Diegale are reserved for private customers and moral persons such as companies, groups, cavisti under certain conditions (weddings, sales to companies).

 The customer declares, after validating the order, to have accepted these GCS and consequently to adhere to them completely.


Article 3:   How to purchase

The DIEGALE  control service retains the right to require from the customer the identity and address documents (identity card, tax code, chamber of commerce certificate, intra-community VAT number for moral persons) for validate the order. In case of refusal by the customer or non-compliance of the documents, DIEGALE is entitled to refuse and cancel the order. If the customer refuses to submit to an inspection, such refusal may cancel the order.

 The control service has the right to cancel an order even if it believes that the latter has various anomalies or irregularities (doubts about the customer's identity, creation of irregular accounts…).

The invoice issued by DIEGALE is available in the customer account, heading « i my orders », on the Diegale website. Upon simple request, the same invoice can be sent to the customer by email or to his billing address.

In accordance with the law n ° 80 336 of 1 May 1980, relating to the retention of title, the products remain the property of DIEGALE until they have been paid in full.

The customer becomes the owner and responsible for the items upon receipt, and the transfer of ownership is considered a transfer of risk.


Article 4:   Payment methods and prices

Shipping costs depend on the shipping method chosen by the customer and the country of destination.

Article 5: Shipping:

Shipping on Italian national territory:Upon receipt of payment, DIEGALE  proceeds with the shipping operations. The latter is carried out at the address specified by the customer : the information indicated by him is under his responsibility. In case of errors or lack of information causing a problem or non-receipt of the goods, the DIEGALE company will not be held responsible in any way. In case of return of the goods due to an incomplete address, the customer will have the possibility alternatively to change the shipping address and arrange a new shipment at his own expense, or to obtain a refund of the order excluding shipping costs. initials.

In case of stock out of stock of a particular ordered product, DIEGALE undertakes to inform the customer as soon as possible, proposing the following different alternatives :

Item 7:   Business operations and benefits :

Article 8:  Right of withdrawal:


The customer  has the right to withdraw from this contract without giving any reason within fourteen days.

The withdrawal period expires fourteen days after the day on which  the customer or a third party, other than the transporter and designated by him, physically takes possession of the goods.

To exercise this right,  il customer  is obliged to communicate the aforementioned decision to withdraw from this contract with a clear statement (for example, letter sent by post or e- mail).

In order for the withdrawal deadline to be respected, it is sufficient that  the customer sends the communication concerning the exercise of the right of withdrawal before its expiry.

Effects of withdrawal

If you withdraw from this Agreement, we will refund all payments received, including shipping costs (except for any additional charges resulting from choosing a delivery method other than the least expensive standard we offer) without undue delay and, in in any case, no later than fourteen days from the day on which we were notified of your decision.
The refund will be made using the same payment method used for the original transaction, unless you expressly accept a different method, in any case, this refund will not result in any charge to the user.
